1. Services

Simple Moving Inc. provides local and long-distance moving, packing, and related services based on estimates, availability, and agreed terms.

2. Estimates & Pricing

Non-Binding Estimates (Default)

All estimates are non-binding unless explicitly stated otherwise in writing.

  • Final charges are based on actual time, materials, and services performed
  • Additional charges may apply for extra labor, stairs, long carries, bulky items, or changes in inventory
Binding Estimates (If Issued in Writing)

If a binding estimate is provided:

  • The total price will be based on the agreed inventory and scope
  • Additional services or items not included may result in extra charges
Double Drive Time (California Compliance)

For hourly moves within California:

If the distance between pickup and delivery exceeds 10 miles, double drive time will be applied.

Per CPUC regulations:

Total billable time = Loading + Unloading + Double the driving time between origin and destination

3. Customer Responsibilities

You agree to:

  • Provide accurate and complete information
  • Ensure access to locations (including elevators, stairs, and entry permissions)
  • Provide legal parking for moving trucks; you are responsible for any tickets, citations, or towing
  • Properly pack items unless packing services are requested
  • Disclose fragile, valuable, or specialty items

4. Payment Terms

  • Payment is due upon completion of services unless otherwise agreed
  • Deposits may be required to secure bookings
  • Accepted methods include cash, card, Zelle, or other approved methods

5. Cancellation & Rescheduling

  • Advance notice is required
  • Deposits may be non-refundable depending on timing

6. Liability & Valuation (California Compliance)

All moves are subject to Released Value Protection at $0.60 per pound per article, as required by California law.

  • Additional valuation coverage may be available upon request
  • Customers must declare high-value items in advance

7. Damage Claims & Deadlines

To be eligible for consideration:

  • Visible damage must be noted at the time of delivery on the Bill of Lading
  • All claims must be submitted in writing within 9 months of delivery date
  • Supporting documentation (photos, descriptions, weight, proof of value) is required

We reserve the right to:

  • Inspect items before resolving claims
  • Repair, replace, or compensate based on valuation coverage

Failure to follow these procedures may result in denial of the claim.

8. Appliance Handling Disclaimer

  • Movers are not licensed technicians
  • We may assist with water-line appliances only with a signed waiver
  • We do not disconnect gas appliances under any circumstances
  • We are not liable for damages resulting from disconnection/reconnection

9. Prohibited Items

We do not transport:

  • All liquor/alcohol bottles
  • Flammable or hazardous materials
  • Illegal or perishable items

Undisclosed prohibited items may result in refusal of service.

10. Property Conditions & Right to Refuse Service

We reserve the right to refuse or stop service if conditions are unsafe or unsanitary, including:

  • Pet waste
  • Infestations
  • Excessive debris or hazardous conditions

Charges for time spent may still apply.

11. Delays & Force Majeure

We are not liable for delays caused by:

  • Traffic, weather, or access issues
  • Building restrictions
  • Circumstances beyond our control

12. Communication Consent

You agree to receive communications via phone, SMS, and email, including service-related notifications.

13. Chargeback & Payment Disputes

By using our services, you agree:

  • Not to initiate chargebacks without first contacting us to resolve the issue
  • Any chargeback filed without prior written notice may be considered a breach of this agreement
  • You remain responsible for all valid charges, including fees, collections costs, and administrative expenses associated with improper chargebacks

We reserve the right to submit documentation, including signed agreements, service records, and communications, to dispute any chargeback.

14. Arbitration & Dispute Resolution

Mandatory Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to our services shall be resolved exclusively through binding arbitration, rather than in court, except for small claims matters.

  • Arbitration shall be conducted in the State of California
  • Each party shall bear its own legal fees unless otherwise required by law
  • You waive the right to a jury trial and participation in class actions

15. Limitation of Liability

To the maximum extent permitted by law:

  • Liability is limited to the selected valuation coverage
  • We are not liable for indirect, incidental, or consequential damages

16. Website Use

You agree not to misuse our website or attempt unauthorized access.

17. Accessibility & Non-Discrimination

We comply with all applicable civil rights laws and provide equal service access.

18. Changes to Terms

We may update these Terms at any time.
